The contract, associated plans and specifications are highly technical and complex but are often misunderstood or overlooked in the excitement to get a project started.

If you have not engaged an architect to administer your building contract, a simple error may lead to tens or even hundreds of thousands of dollars in extra costs, stress and time that may potentially escalate into a building dispute  with your builder, designer, construction company or draftsperson. 

Do you REALLY understand your Home Warranty Insurance?

Most Australian jurisdictions have mandatory Home Builders Warranty Insurance that is intended to provide you with a means of recourse if there is a problem with your building works when your builder is no longer in a position to rectify. 

There is a misconception amongst many consumers that Home Warranty Insurance will comprehensively protect you. Nothing could be further from the truth.

The facts are that the Builders Warranty Insurance can only be called upon if the builder is deceased, disappears (and cannot be found), or becomes insolvent. In all other circumstances you are on your own to sort things out with your builder – you need an independent building expert on your side to help protect your interests and make sure that you get what you are paying for.

It is extremely important that you understand the requirements in your State before you enter into any arrangement with a builder or tradesman to undertake work.

Home Builders Warranty Insurance generally must be provided by your builder or tradesperson if the works exceed a certain amount (which varies by jurisdiction but generally between $3k and $12k in total works cost).  The insurance coverage available also varies between around $50k and $200k and may or may not include legal costs.

STAGE 1 - Contract Review

STAGE 2 - Base

After concrete footings are poured, or after stumps, piers, columns, or the concrete floor has been completed

STAGE 3 - Frame

Wall and roof frames have been completed

STAGE 4 - Lock up

External walls are complete, windows, doors and roof coverings are fixed and the flooring has been laid

STAGE 5 - Services (pre-lining)

Preliminary plumbing and electrical works completed, wall insulation installed

STAGE 6 - Fix/Fit-out (pre-paint)

When all interior work is complete and the house is ready for painting

STAGE 7 - Pre-Handover

When the house is presented for handover

STAGE 8 -  Maintenance Period Expiry

A final inspection just before the Maintenance or Defects Liability period expires (typically 3-6 months after completion)
